Article 1: General provisions
The e-commerce website of Fluffy Slimes, a one-man business with its registered office at Krombekestraat 26, 8691 Stavele, VAT BE0762 464 144, offers its customers the opportunity to purchase the products from its online shop online.
These General Terms and Conditions (‘Terms and Conditions’) apply to any order placed by a visitor to this e-commerce website (‘Customer’). When placing an order via Fluffy Slimes' online shop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, except when previously, in writing and expressly accepted by Fluffy Slimes.
Article 2: Price
All stated prices are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer.
If delivery, reservation or administrative costs are charged, this will be stated separately. The Customer can always consult the delivery costs on the site under Delivery & Shipping.
The stated price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.
Article 3: Offers
Despite the fact that the e-commerce website is compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind Fluffy Slimes. As regards the accuracy and completeness of the information offered, Fluffy Slimes is only bound by an obligation of means. Fluffy Slimes is under no circumstances liable in case of manifest material errors, typesetting or printing errors.
If the Customer has specific questions about e.g. texture, colour, fragrances, availability, delivery period or delivery method, we request the Customer to contact us in advance at info@fluffyslimes.be or by phone 0496 07 94 47.
The offer is always valid while stocks last and may be amended or withdrawn by Fluffy Slimes at any time. Fluffy Slimes cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this is explicitly stated in the offer.
Fluffy Slimes tries to portray items as faithfully as possible. However, please keep in mind that factors such as a computer screen, ambient light, ... can make the colour in particular deviate from reality.

Article 4: Online purchases
The ordering procedure through Fluffy Slimes is as follows:
Select the desired product and add it to the shopping cart.
Press the ‘Order’ button, after which your login details will be requested.
If you are not yet registered, you can provide your delivery choice and address details by creating an account.
Press the ‘go to payment’ button, after which you will be asked to select your preferred means of payment to confirm the order.
Press the icon of your preferred method of payment to complete the payment via a secure connection.
After ordering, Fluffy Slimes will send an order confirmation by e-mail, be sure to check your spam as sometimes our e-mails are seen as advertising.
If the products are in stock, a second e-mail will be sent when the shop has shipped your order, you will also receive a tracking link.
The Customer has the choice between the following payment methods: by credit card and by bank card.
Fluffy Slimes is entitled to refuse an order due to a serious fault of the Customer in relation to orders involving the Customer.

Article 5: Delivery and execution of the agreement
Your order will be shipped on average within three working days after receipt of your payment unless otherwise notified. Should there be abnormal delays in the delivery time due to force majeure or other unforeseen circumstances, we will inform the Customer immediately, Including information on the updated delivery time. No delay in delivery can give rise to cancellation of the purchase or payment of damages in favour of the Buyer, except in cases of deliberate delay. Erroneously communicated delivery addresses are the responsibility of the buyer and may give rise to additional charges. Unless otherwise specified, our prices do not include transport and delivery of the goods to the buyer, these costs are stated separately.
We are not liable for damage, in case of loss or other problems during shipment.
We make every effort to avoid these problems, the packages are made with the greatest care. The buyer is obliged to check the condition of the delivered goods when they are handed over by the transport company.
Should the packaging of the delivered goods be opened and/or damaged, the purchaser must notify the transport company and note this on the dispatch note at the time of acceptance.
Each parcel can be tracked online using a unique barcode. In the event of problems with the receipt of the dispatched parcel, the Customer may contact the carrier quoting this barcode.
If the Customer requests a mode of delivery that differs from the mode applied by us, any additional costs will be charged to the Customer.
The risks of loss and damage to the goods are transferred to the Customer at the time of delivery. However, if the Customer fails to fulfil its contractual obligations, the risk of loss and damage to the products will pass to the Customer at the time when delivery should have taken place without breach of obligations on the Customer's part.
Any costs, taxes, customs and import duties as well as formalities linked to deliveries outside Belgium are entirely the responsibility of the buyer.
Fluffy Slimes is not liable for the consequences of non-compliance with certain payment, tax and/or declaration obligations associated with deliveries outside Belgium.
Customers may cancel free of charge if for any reason goods cannot be delivered within 30 days of the conclusion of the contract.
Delivery is made by Bpost and the duration and costs involved can be consulted under ‘delivery and shipment’.

Article 6: Retention of title
The delivered items remain the exclusive property of Fluffy Slimes until paid for in full by the Customer.
The Customer undertakes, if necessary, to draw the attention of third parties to Fluffy Slimes' retention of title, e.g. to anyone who might come to seize items not yet paid for in full.
Article 7: Right of withdrawal Slimes
Our mission is to make the slimes as unique and beautiful as possible for you. Sometimes the product may not meet your expectations, be sure to let us know if this is the case. We want to hear your opinion to make our slime better.
All slime sales are final. We cannot provide refunds or exchanges due to the nature of the product and due to hygiene standards.
Our slimes are completely handmade. The slimes may vary in colour, size, texture and smell. However, this is normal as they are handmade products.
The slimes are carefully packed to prevent damage during transport. Should your order still be damaged, please let us know and send us a photo via info@fluffyslimes.be within 3 days of receiving your order. We will provide an appropriate solution. Shipping costs will not be refunded under any circumstances.
Article 8: Guarantee
Pursuant to the Act of 21 September 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.
In case of questions, comments or complaints, the customer can contact Fluffy Slimes at any time by mail info@fluffyslimes.be or by phone 0496 07 94 47 and this within the 5 calendar days following the delivery to the buyer. Provide us with photos and the description of the defects. Fluffy Slimes will deal with the customer's request as soon as reasonably possible and will contact the customer concerned. If the question, comment or complaint relates to the guarantee, in principle the manufacturer/producer should be involved, so the handling of the request or complaint may take more time.
The guarantee (commercial and/or legal) shall never apply to defects arising as a result of accidents, neglect, falls, use of the article contrary to purpose for which it was designed, non-compliance with the instructions for use or manual, modifications or alterations to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Article 9: Liability
Fluffy Slimes cannot be held liable for the incorrect use of the slime or toys. Both on the slime product (packaging) and on our website, we mention several times about the risks and dangers of slime toys.
You should not buy slime if you think you have an allergic reaction to household detergents, paint, shaving foam, artificial snow, lotion, clay, borax, glycerine, cornstarch, soap, fragrances and/or essential oils. Recommended from age 6 onwards. Small parts pose a choking hazard. Keep away from babies and pets (including couches, clothes and hair). SLIME IS NOT EDIBLE!
If misused as a toy, it can pose a danger to small children. As slime is wet and elastic, the risk of swallowing is high. Our products are scented and can smell like food, which can encourage children to engage in dangerous behaviour, such as tasting and even chewing the product. This can irritate the nose, throat or eyes, especially in children. Parents and carers can take measures to prevent children from swallowing mucus products. Our mucus contains a chemical called borax. Ingestion can be a health hazard for your child.
Slime is a wet and elastic toy. The more it is played with, the more bacteria are ingested. If the packaging of slime toys is not sealed after playing, the risk of bacteria increases.

Article 10: Penalties for non-payment
Without prejudice to the exercise of other rights available to Fluffy Slimes, in the event of non-payment or late payment, the Customer shall be liable, ipso jure and without formal notice, to pay interest at 10% per annum on the unpaid amount. In addition, the Customer shall be liable ipso jure and without formal notice to pay a fixed indemnity of 10% on the amount in question, with a minimum of €25 per invoice.
Without prejudice to the foregoing, Fluffy Slimes reserves the right to take back items not (fully) paid for.

Article 11: Privacy
The data controller, Fluffy Slimes, respects the General Data Protection Regulation and the Belgian Privacy Act of 30 July 2018.
We treat your data as confidential information and will never transfer, rent or sell it to third parties. However, we do pass on your details (email address and phone number) to the courier service so that they can send you a confirmation email and/or SMS with track and trace number.
You have a legal right to inspect and possibly correct, supplement or delete your personal data.
We need this data to handle your order, for delivery, invoicing, marketing and advertising purposes.
We keep your data absolutely private and store them in our secure, non-public database.
Article 12: Use of cookies
Our Website uses cookies and similar technologies. This helps us to provide you with a better user experience when you visit our Website and also allows us to optimise our Website. Without your prior consent, we only set the purely functional cookies that are necessary for our Website to work correctly. For all other cookies, we request your prior consent.
On your first visit to our Website, you will be asked to accept our cookies. You can subsequently manage your choices yourself at any time.

Article 13: Impairment of validity - non-derogation
If any provision of these Terms is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.
Failure at any time by Fluffy Slimes to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.
Article 14: Modification of conditions
These Terms and Conditions are supplemented by other conditions explicitly referred to and the general terms and conditions of sale of Fluffy Slimes. In case of contradiction, these Terms and Conditions shall prevail.
Article 15: Proof
The Customer accepts that electronic communications and back-ups may serve as evidence.

Article 16: User comments, suggestion box, feedback and other submissions
If, at our request, you send certain specific submissions (e.g. contest submissions), or without a request from us, you send creative ideas, suggestions, proposals, plans or other material, online, via social media, by email, by post or otherwise (collectively, ‘comments’) you agree that we may edit, copy, publish, distribute, translate and otherwise use the comments you transmit to us at any time and without limitation in any medium. We are not and will not be obliged (1) to keep any comments confidential; (2) to pay a fee for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine, in our sole discretion, to be unlawful, offensive, threatening, defamatory, libelous, pornographic, obscene or otherwise objectionable or in violation of any party's intellectual property or these Terms of Service. . You agree that your comments do not violate any rights of any third party, including copyright, trademark, privacy, personality or other personal or proprietary rights. You further agree that your comments will not contain defamatory or otherwise unlawful, offensive or obscene material, or contain computer viruses or other malware that may in any way affect the operation of the Service or any related website. You must not use a false e-mail address, impersonate anyone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and accept no liability for any comments posted by you or any third party.
Article 17: Applicable law - Disputes
We naturally hope that all our customers are always satisfied.

Belgian law is applicable, with the exception of the provisions of international private law on applicable law.
The court of Veurne has jurisdiction in the event of legal disputes.
